Contract
This contract is a memorandum of understanding between the following two parties under an agreement for responsibilities and liabilities in specific cooperation where The Holy Paradise - Leisure Services with all the efforts in providing accommodation and in managing other requested arrangements hereinafter referred to as ’The Agent’ , acts only in the capacity of a booking agent for hotel or villa or holiday accommodation and other contractors and stand on behalf of those contractors. This contract entered into is between the owner of the property or contractor and the Holidaymaker, hereinafter referred to as ’The Client’.
This contract is fully effective only when both parties run cooperation as mentioned above and will turn to ineffective when all necessary payments have been fully received by The Holy Paradise, and the clients has received all the requested services.

Rates & Services
Attached prices are quoted in USD Dollar and subject to change without prior notice. The quoted price match to the total person mentioned to occupy in every property includes the services as mentioned in property details. Attached rates inclusive welcome drink, chilled towel upon arrival, canapé/fruits basket upon arrival and both ways airport transfers (1 x arrival pick up and 1 x departure drop off – To all guest parties) Please note that additional transfer cars will be charged at US$ 20 each for Seminyak, Kerobokan and Canggu area and US$ 30 each Ubud, Ketewel, Tabanan and Uluwatu area.
Suitability for Occupancy
The property and amenities available for only limited number of party; it is strictly forbidden to accommodate persons exceed the maximum number stated in the property description unless by prior special addendum statement. The Holy Paradise reserves the right to refuse additional person or to charge a penalty for any additional person or to strictly release any booking without prior notice. To avoid any inconvenience with such case, it is advised to the Hirer to inform a precise number of parties with additional or change while booking is made.
Term of Payment
All bookings expectedly followed by deposit payment to keep the space or services you need being secured. Deposit of 50% of the total rental amount must be received by The Holy Paradise within two (2) working days after confirmation of reservation has been given.
All payments must be made in US Dollars with payment options as follows:
I. Payment by Telegraphic Transfer – All charges incurred for Telegraphic Transfer transactions will be shouldered by the client.
II. Payments made by Visa and MasterCard subject to a 3.5% local bank administration charge .
All payments by Credit Card require to be converted into the local Indonesian Rupiah currency. Payments by Credit Card are calculated on the banks exchange rate on the day of transaction. Differences in personal statement balance can occur and due to the fluctuations with the Indonesian Rupiah and length bank processing time. The Holy Paradise will not take any risk and responsibility for these differences.
Final payment is required at least 45 days prior to arrival for Low Season and 60 days for High/Peak Season bookings. Payment must be received promptly in order to guarantee your reservation.
All clients will be asked to sign a waiver of Liability and a credit card authorization form, which will allow the Agency or Villa Management to charge to the credit card should there any extra usage of services that clients incur during staying at the villa or during the period of holiday. In case of bookings made 45 days prior to arrival, full payment is required within two (2) working days, or on arrival at the latest, if less booking made than two (2) working days, payment upon arrival is needed.
Please avoid settling the payment by Dollar notes with serial number beginning with CB, BB, CF, DB and CA and notes that are issued year 1999 and under. The Agent or Villa Management WILL NOT accept it in accordance with the advice of Bank Indonesia.
Payments by Traveler’ s Cheques or personal cheques, IS NOT ACCEPTED for whatever the reason.
Cancellation Policy
Should there be any cancellation or amendment of traveling schedule, notice of cancellation must be received by The Holy Paradise in writing by fax or email at least 30 days prior to arrival for Low Season, 45 days prior to arrival for High Season and 60 days for Peak Season bookings.
Deposit will be refunded in full less US$500.00 OR 20% of monies received (whatever is greater), if the booking is cancelled 61 days or more prior to arrival (91 days for Christmas/New Year bookings).
In the event a reservation is cancelled less than 61 days prior to arrival the deposit will be forfeited. Reservations cancelled less than 61 days prior to arrival are subject to a complete forfeiture of deposit to compensate the agency for the time and effort involved in making a booking and to compensate the owner for the loss of other potential bookings that have turned down once a booking has been confirmed. Final Payments are non-refundable.
Travel Document and Immigration Formalities
It is really IMPORTANT to extend your passport prior to any other travel arrangements. On Indonesia’ s immigration law you will not be able to enter the country when your passport is reaching limit of valid less than six months. There have been facts in the past that clients holding passport with validity less than six months were strictly rejected to enter the country through Bali International Airport or any other International Airport around the country.
Registration with Indonesian Authorities
We are required by Indonesian law to register all guests with the local authorities. On arrival the Management of the villa will temporarily take your passport to photocopy, then making sure that you are registered with the authorities.
Bali Holiday Seasons
There are different rates on holiday accommodation in Bali. Different rate will applied for your holiday in accordance with Bali Holiday Season. The seasons are:
Peak Holiday Season: - August 1st to August 31st
- December 20th to January 8th
High Holiday Season: - July 1st to July 31st
- September 1st to September 15th
- Chinese New Year & Easter Week
Normal Holiday Season: - January 9th to June 30th
- September 16th to December 19th
- Excluding Chinese New Year & Easter Week
Length Stay
Unless specified in detail of every villa, there are minimum stay of three (3) nights for Low Season, seven (7) nights for High Season and ten (10) nights for Peak Season at all of the properties.
Check In & Check Out Time
Check in time is 2:00pm. Check out time is 11:00am. Late check out up to 6pm a half day rental charges will be applied. Late check out up to 11pm a one night rental charges will be applied.
Special Events or Parties
For the reasons of privacy, wedding party and other events at private villas are being popular lately and the demands for such event are increasing from time to time.
It must be understood that you are staying side by side with other at separated private villa and the villas mostly located among the local communities. You are not allowed to hold large parties in any of the private villas without prior arrangements and permission.
The Hirer should be aware that the majority of villa owners will not accept a booking involving a function without prior acceptance from the neighbors and prior confirmation that a function coordinator has been employed.
This signed agreement is applied for cooperation in serving for vacation purposes only. Any other events and parties will urges for special permission to be obtained in prior for function and much depends on the acceptance of the neighboring residents. It is strictly forbidden to celebrate large parties in any of the private villas without prior notice, agreement and arrangement. When is allowed for an event, Agent and Villa Management will have to obtain a license from the local authorities for such events in prior and this needs extra fee. All villas we represent have rules governing their usage for events and parties and at times as surcharge of up to equivalent of a night’ s rental, price plus fee for local community or ’ Banjar’ and local security “Pecalang” in guard-watching the running party.
If you insist for a party or other event in Villa those supposed to accommodate large number of attendants, please inform your agent and Villa Management in advance to get a license from the local authorities, permission and acceptance from local community for such events
Travel Insurance
As the needs of each individual travel insurance requirements are different, it is strongly recommend the travelers to take their own travel insurance to be fully insured. All prices of the packages do not include and do not provide any travel insurance coverage. Greatly recommend that you take along a comprehensive insurance to protect you and all those that accompanying you for the whole period of holiday against illness, injury, death, loss of baggage and personal valuable items, cancellations and other travel contingencies. Check your health insurance before coming to make sure you are covered. We also strongly recommend a health insurance that covers medical evacuation for emergencies.
Liability and Responsibility
1. The Agent makes all efforts in providing holiday accommodation and other arrangements required by hirer. In all efforts to fix up every requirements of the hirer, The Holy Paradise acts only in the capacity of a booking agent for holiday accommodation or tour arrangements. Through this online media, brochures or other promotion means The Agent makes every effort to provide accurate information and descriptions match to the properties on its reality and that property and its amenities meet the hirer’ s requirement and demand. In force majeure the Agent will not take responsibility for any alterations or changes made to the property or its amenities which are beyond its control.
2. The Holy paradise shall not be liable to the client or to any other occupier or guest on the property for any injury, sickness, loss, damage, additional expense or inconvenience caused and will not accept responsibility for any loss or damage to personal belongings, car and its contents to any member of the party during the holiday. The Holy Paradise will take no responsibility for any injury, sickness, loss, damage, or any other problem with hirer’ s personal belongings, car, and its contents of the hirer or any member of the party during the holiday.
3. During the period of holiday the Hirer agrees herein after to take fully responsibility to the property, amenities and its contents; and the Hirer accepts to responsible to any change, lost or damage of any amenities of the property or additional expense or inconvenience directly or indirectly caused by or arising out of the use of the property and its amenities, and the change of its appearances, plumbing, gas, electrical or others, except it caused by owner’ s negligence or weather conditions.
Complaints & Claim
Should there be any inconvenience during holiday season and the Client considers that he/she has real and rational reason or evidence case for complaint concerning a property or its services, the matter should firstly be demonstrated to the Villa owner or Villa Manager to manage for better.
But if fatal case could not be recovered and it causes the client to lose satisfaction and happiness, the client should then evidently proof the case and officially report the matter at once to The Holy Paradise. In such cases, if the Agent considers the complaint valid and no more ways to recover it, a reasonable compensation may be countable to be discussed with the relevant villa management and may take some times to finalize. No liability shall arise beyond the compensation or refund of the monies paid.
The Holy Paradise will not pay any attention to the complaint, claims or petitions when a service is used out or after departure or after leaving the property which is no longer possible to investigate the complaint neither to demonstrate the case effectively.
